Acceptable Use Policy
Effective Date: May 15, 2026
This Acceptable Use Policy ("AUP") governs your use of ArtEmotion, Inc.'s services ("ArtEmotion" or the "Service"). It is incorporated into and forms part of our Terms of Use. Violation of this AUP may result in immediate suspension or termination of your account, refusal of service, and reporting to law-enforcement authorities where required by law.
1. Zero-Tolerance Categories
The following are prohibited absolutely — there is no permitted use case, no opt-in, no exception, and no creative or research justification.
- Child Sexual Abuse Material (CSAM) and any sexual or sexualised depiction of a minor (real or AI-generated). Suspected CSAM is reported to the National Center for Missing & Exploited Children (NCMEC) where applicable, and the originating account is permanently terminated.
- Non-consensual intimate imagery (NCII), "revenge porn," or sexual depictions of any identifiable real person without that person's documented consent.
- Content that incites or facilitates terrorism, mass violence, or acts of genocide.
- Content depicting graphic real-world violence or torture for the purpose of glorifying it.
- Targeted harassment or doxxing of identifiable individuals.
2. Prohibited Uses
You may not use the Service to generate, upload, distribute, host, or facilitate:
- Pornography or sexually explicit imagery. Our content safety filter is enforced server-side on all generations and cannot be disabled by users.
- Deepfakes or face-swap content of identifiable real persons (public figures, celebrities, private individuals) without that person's documented, written consent. This includes but is not limited to: politicians, performers, athletes, executives, and minors. References to real people by name in prompts are blocked at submission time.
- Misinformation, disinformation, or content designed to deceive viewers about a real person's statements, actions, or identity. This includes fabricated news content, fake quotes, fake speeches, and fake endorsements.
- Election interference: content depicting candidates, election officials, or polling processes in a manner intended to influence voting behaviour, suppress voter turnout, or create false impressions of electoral events.
- Medical, legal, or financial advice presented as authoritative or as coming from a real professional, qualified institution, or regulated entity.
- Trademark, copyright, or right-of-publicity infringement. Do not generate logos, brand assets, copyrighted character likenesses, or commercial imagery you do not have the right to produce. Do not generate content designed to mimic the trade dress of any brand without authorisation.
- Malware, phishing assets, or content designed to defraud. This includes fake login pages, fake invoices, and counterfeit document templates.
- Hate speech, content that demeans protected classes, or imagery glorifying hate groups.
- Weapons design, drug-synthesis instructions, or other content providing operational uplift to physical-world harm.
- Service abuse: automated scraping that exceeds documented rate limits, attempts to bypass our safety controls, attempts to extract model weights, or attempts to use the Service to train competing models.
3. Inputs You Upload
By uploading any image, video, or audio to the Service, you represent and warrant that:
- You own the input or have all rights, licenses, and consents necessary to use it.
- If the input depicts an identifiable person, that person has consented to AI processing of their likeness for the purpose you are using.
- The input is not subject to any third-party intellectual-property or privacy claim that would make your generation unlawful.
- The input is not, and does not contain, CSAM. Uploaded media is subject to automated and manual moderation.
Tools that accept face imagery require an explicit per-session consent confirmation before generation is enabled.
4. Outputs You Generate
You are solely responsible for what you do with content you generate using the Service. You may not:
- Distribute outputs in a manner that violates any provision of this AUP.
- Misrepresent AI-generated outputs as authentic photographs, video, or audio recordings of real events or real people, except where the synthetic nature is clearly disclosed.
- Remove, obscure, or alter any provenance metadata embedded in outputs by the Service.
5. Enforcement
We enforce this AUP through a combination of:
- Provider-level safety filters: third-party model providers run their own content safety classifiers. We force these on at the request layer; users cannot disable them.
- Prompt-time blocking: prompts containing references to real public figures by name, CSAM patterns, or explicit deepfake-intent language are rejected before reaching any provider.
- No adult-content category: ArtEmotion does not offer a mature-content tier or NSFW unlock. The platform is age-restricted to users 18+ by Terms.
- Account-level controls: rate limiting, audit logs, account suspension and termination, and where required by law, reporting to authorities.
- User reporting: anyone may report suspected abuse to [email protected] or via our abuse report form.
6. Reporting Abuse
To report content or accounts you believe violate this AUP, including suspected CSAM, NCII, impersonation, or intellectual-property infringement, please use one of the following channels:
- General abuse / NCII / impersonation: [email protected]
- Suspected CSAM: report immediately to [email protected] with subject line "URGENT — CSAM". Do not include the suspected material in your message; link to the URL or include the originating account email instead. We escalate to NCMEC and law enforcement as required.
- Intellectual-property and DMCA: [email protected]
We aim to acknowledge abuse reports within 24 hours and to action verified violations within 72 hours.
7. Updates
We may update this AUP at any time. Material changes will be communicated to active subscribers via email and posted on this page with an updated effective date. Continued use of the Service after the effective date constitutes acceptance of the updated AUP.
